Qloaked's DMCA Policy and Procedures

Since we respect artist and content owner rights, it is Qloaked's policy to respond to alleged infringement notices that fully comply with the Digital Millennium Copyright Act of 1998 ("DMCA"). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify Qloaked's copyright agent as set forth in the DMCA.

Filing a DMCA Notice

For your complaint to be valid under the DMCA, you must provide the following information in writing:

• An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
• Identification of the copyrighted work that you claim has been infringed;
• Identification of the material that is claimed to be infringing and where it is located on the Service;
• Information reasonably sufficient to permit Qloaked to contact you, such as your address, telephone number, and email address;
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY AND CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS' FEES.

Counter-Notification Procedure

If you believe that the material you posted on the Service was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to Qloaked's designated agent. The counter-notification must include:

• Your physical or electronic signature;
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
• Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if you are outside of the United States, the jurisdiction of any judicial district in which the Service may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward it to the original complainant and inform them that we may restore the removed material or cease disabling access to it in 10 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringer.

Termination for Repeat Infringers

In accordance with the DMCA and other applicable law, Qloaked has adopted a policy of terminating, in appropriate circumstances, the accounts of Users who are deemed to be repeat infringers. Qloaked may also at its sole discretion limit access to the Service and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
